International Human Rights Perspectives on the Fundamental Right to Education—Integration of Human Rights and Human Development in the Indian Constitution

Abstract

This Article provides for a legal, jurisprudential, and constitutional foundation for
developing the right to education in India. The right to education is specifically addressed from an
international human rights perspective and the Indian constitutional perspective. The Article
underscores the need for ensuring that the right to education is constitutionally protected as an
economic and social right. It also stresses the necessary governance measures taken with a view to
achieve full realization of this right. The formulation of necessary enforcement mechanisms in
India for enforcing the right to education becomes an important theme in the Article, particularly
when it is examined in the context of integration of human rights and human development.
